Terms of Service

Usage Agreement

Clause 1: Objective
The purpose of these terms of agreement is to govern the user registration service and stipulate the rights, obligations, 
and responsibilities engendered by the use of the service offered by Anyang to You.

Clause 2: Definitions of Terms
 ① According to this contract between the "User" and "Anyang", a "Service" contract is made and by applying for a unique identifier token (ID) you agree to be bound by the terms of this Service with Anyang. 
 ② The "User ID" is used to provide the Service to the User and to differentiate between Users. The User ID is registered by the User him or herself and is a combination of the letters and numbers that Anyang has approved for use. 
 	 The User ID prevents the personal information of the user from being abused.  The User ID is used so that the diverse offerings of foreign-language Services offered by Anyang can be used by the User without further identification needed beyond that of logging in. 
 ③ A "Password" is a number used to verify a user through the combination of the User ID and the Password. The Password is composed of numbers and letters that the User has selected when registering. 
 ④ "Cancellation" is the action of rendering this usage agreement null and void after having completed a Service contract for the User for the foreign-language website.

Clause 3: User Registration (and formulation of the Usage Agreement for the Service)

① If the person desiring to become a User clicks in Agreement with the Service Usage Agreement on the user registration page, this is taken to indicate agreement with the terms set out in this contract. 
 ② A necessary part of the registration process is filling in the User information form provided by Anyang. 
 ③ By Agreeing to this Use Agreement governing the use of the Service provided between Anyang and the User when registering, Anyang uses the method of requiring email address verification. Once the User has attained the status of membership the User is the qualifications of a User.

Clause 4:  (Approval of a request to use the Service)
Anyang will not approve a request to use the Service when any of the following cases apply:

A. when Anyang lacks the facilities to do so  
 B. when there is a technical difficulty in accepting the use request 
 C. when the User attempts to request to use the Services using a false name  
 D. when a request is made under the name of another person  
 E. when a request is made using false user information 
 F. when the request is made for the purpose of going against established morals and customs or the peace and order of society 
 G. when the steps used to make the request as established by Anyang have not been followed  
 H. whenever Anyang has decided that it would be put in a compromising situation were it to accept the request to use the Service

Clause 5: (Protection of Private Information)

② Anyang must of necessity get the permission of the User before collecting personal information. 
 ③ Personal information of the User that was collected by Anyang without having received the permission of the User cannot be provided to a third party or used in any way. However, the following are exceptions to this rule:  
 
 A. when the objective is to compile statistics, advertising materials, do educational research, etc. that do not differentiate between specific Users
 B. when a request to produce information is received from another governmental institution in accordance with an order given based on the Basic Digital Information Law 
 C. in cases where it is allowed to undergo specific actions such as offering User information to a 3rd party or using the User information based on other related legal orders 
 ④ The User can at any time make a request to view, edit, or delete his or her personal information, and such a request must be immediately handled by Anyang when it is received. However, if Anyang has difficulty identifying a user, a technical problem, or a problem with its facilities which makes it difficult to immediately handle such a request, Anyang will alert the User of such a situation and the period within which the request can be handled will be extended to 10 days.  
 ⑤ Anyang will limit the administrator of the User's personal information to a responsible person within Anyang and will minimize those who handle such information. 
 ⑥ The term of use and the time period over which Anyang will store the personal information is limited to the time required to collect the information and to perform the purpose it was to be used for, after which without exception the information will be destroyed.

Clause 9: (Obligations of Anyang)

① Anyang will not provide a User's personal information that it has come to know as a result of having been provided to use the Service and for related purposes to any third party, whether by leaking it or divulging it, without obtaining permission from the User. However, an exception is made for when a request for the information comes from a government institution according to the stipulations of the Basic Digital Information Law, or a request is made as part of a criminal investigation, or the request comes from the Information & Communications Ethics Committee, or when any request is made according to some legally valid procedure. 
 ② When a complaint or opinion received from a User is deemed to be well-founded in reason, Anyang will swiftly handle the complaint. However, when it is difficult for Anyang to swiftly handle the complaint, Anyang shall notify the User of the reason and the date it will be handled by. . 
 ③ Anyang will only offer the Service related to the "Foreign-language Version of the Anyang Website", specifically, the Foreign-language Version of the Anyang Website can be used at the time of registration to use the Service, and the Service will not be able to be used after the User cancels his or her membership.

Clause 10 (Obligations of the User)

① When the User uses the Service, the following listed behavior must be restrained from:  
 
 A. using the ID and Password of another user for bad purposes 
 B. broadcasting, publishing, duplicating, offering to a third party, or using the information provided by Anyang in any other way than to use the Service, without the express prior permission of Anyang  
 C. acts infringing on such rights as the copyrights of Anyang, the copyrights of a 3rd party, etc. 
 D. acts of distributing to other people diagrams/figures, sentences, or information whose content violates the public order and established social customs 
 E. acts that may objectively be interpreted as being criminal or associated with criminal behavior 
 F. acts that infringe on other legal directives

② The User must abide by the provisions stipulated in this User Agreement, the instructions pertaining to use of the Service contained herein, and all detailed items found herein.
 ③ The User must abide not only by the items mentioned in this Agreement by Anyang pertaining to the Service but must also adhere to usage stipulations that are made public elsewhere.  
 ④ The User must not use the Service for commercial purposes without the express prior permission of Anyang. Anyang will not bear any responsibility for the results of commercial activities nor for the results of commercial activities that the User has performed in violation with this Agreement. If such commercial activities of the User cause any damage or harm to come to Anyang, Anyang will receive compensation for such damage and harm. 
 ⑤ The User cannot donate, delegate, or transfer the rights of this Usage Agreement for the Service or those of any other usage contract to a third party, nor can they be provided as security.

Clause 11: (User obligations concerning the User ID and the Password)

① The User must use the User ID and the Password when using the Service. 
 ② The User assumes all responsibility for managing the User ID and the Password except for where the responsibility of Anyang has been acknowledged based on legal directives governing the protection of information used on a computer network, making a computer network available to be used, and as otherwise set forth in this Agreement.  
 ③ The User is not allowed to inform a 3rd party of his or her User ID and Password so that the 3rd party can use the Service.  
 ④ Anyang will bear no responsibility for cases of damage that are the result of management of the User ID and the User Password, mistakes or negligent use that take place during their use, or their use by a third party.  
 ⑤ If the User ID or Password are stolen or known to have been used by a third party, immediate notification of this must be provided to Anyang and the instructions of Anyang must be followed by the User.

Clause 12: (Content and Use of the Service)

① The following are the content of the Service provided by Anyang:  
 
 A. The Service allows the User to see and destroy his or her own Id.

② The contents of the Service as described in ① above may be altered or supplemented as determined necessary by Anyang in the course of executing the Service. When the Service contents are added to or changed, Anyang will notify Users of this by means of the Anyang forum or by other means deemed appropriate.

Clause 13: (Provision of Information)

① Pertaining to the use of the Service by the User, Anyang may furnish the User with different kinds of information as is deemed appropriate by means of e-mail or the postal service.  
 ② Should the User not desire to receive the information mentioned in ① above, they can inform Anyang that they desire not to receive this information by changing the settings which can be found on the user registration menu or the menu that allows the user information to be edited.

Clause 14: (Posts by the User)

① Uploads or posts by the User may be deleted without Anyang having to notify the User in advance that the deletion will take place for a post or upload that falls into one of the following listed categories pertaining to uploads or posts made by the User in the course of using the Service: (however, Anyang is under no obligation to actually make the deletion of such information)  
 
 A. when the content is criticism directed against or damages the reputation of a 3rd party or another User 
 B. when the content violates the public peace or established social customs or practices  
 C. when the content can be seen as being criminal or associated with criminal behavior  
 D. when the content violates such rights as the copyrights of Anyang or those of a third party  
 E. when the period for displaying posts as established by Anyang has been exceeded 
 F. when the content of the User's homepage or forum (bulletin board) contain lascivious material or links to pornographic sites 
 G. when it is deemed that the content is in violation of other items of this Agreement or legal directives related to it

Clause 15: (Copyrights of Posted Material)

① The following list establishes the rights related to material that has been posted during the use of the Service:  
 
 A. The rights to posted material are retained by the person who posted it. Anyang is restricted to using the posted material within the scope of the Service and the posted material will not be used by Anyang without the permission of the original poster for any commercial or money-raising purpose. However, Anyang may use the posted material for non-commercial purposes or any purpose related to income. Anyang also has the rights to post materials to be used in the Service.  
 B. The User cannot alter the information obtained from the Service by means of any process nor shall the User sell such information nor use the posted material for a commercial purpose.

Clause 16: (Terms of Use of the Service)

① Anyang will operate the Service 365 days a year, 24 hours a day, unless Anyang is experiencing technical difficulties or operational problems. However, the service will be interrupted for the purpose of performing regular scheduled maintenance at the designated time and notice will be made of this beforehand. 
 ② In cases where Anyang cannot provide the Service because of the need to perform regularly scheduled maintenance or for some other reasonable reason, the service will be interrupted.

Clause 17: (Responsibilities regarding Use of the Service)

① Except for the case of an employee of Anyang having given written permission by signing a detailed document delineating the scope thereof, the Service cannot be used for any commercial or business purpose whatsoever including for example the sale of products or services. Expressly forbidden are commercial activities related to hacking, advertisements about making money, and pornographic or lascivious sites as well as the illegal distribution of commercial software. 
 ② Anyang will bear no responsibility for a civil or criminal suit or damages that have resulted from commercial activity carried out in violation of ① above. In addition, if any User is damaged or suffers loss from Anyang as a result of commercial activity that was carried out in violation of ① above, the User will not be eligible to receive indemnity or redress for such loss or damage from Anyang.

Clause 18: (The Provision of Information and the Posting of Publicity Materials)

① Anyang can post publicity material that it deems under its own discretion as not being in violation of any legal directives and which it deems to be appropriate for posting by means of e-mail or on the screen of the Service while operating the Service. In addition, the user agrees by using the Service to such disclosure of publicity material. 
 ② Anyang can provide the User with a variety of information by means of posting within the Service or by means of e-mail if such information is related to operating the Service. However, such emails will only be provided to those Users who have agreed to receive them. 
 ③ Anyang will bear no responsibility for loss or damage incurred as a result of business transactions or correspondence regarding or the participation of the User in business or sales activities that the User participates in because of the publicity postings of Anyang while providing the Service.

Clause 19: (Interruption of the Service)

① Anyang may interrupt all or part of the Service when any of the following reasons apply: 
 
 A. when it is disadvantageous for Anyang to run the Service because of construction or repair work being done on the facilities  
 B. when a core communications provider interrupts the digital transmission of the Service for reasons stipulated in the Digital Commercial Communications Law.  
 C. when there is a reason for it to be difficult for Anyang to continue providing the Service or when doing so is deemed inappropriate, such as would be the case should the commercial objectives of Anyang have changed and a decision to abolish the Service have been made.

② Anyang can interrupt, discontinue, or limit all or part of the Service should it become markedly difficult for Anyang to continue doing so because of a reason outside of its control, including a state of national emergency, a natural disaster, a blackout, a malfunction of the facilities providing the Service, or a flood of traffic.

Clause 20: (Abolishing the Contract and Limiting Use)

① When the User desires to terminate the User Agreement, this can be done by the User him or herself making such a request online or the User clicking the "Cancel Registration" button which can be found on the page for editing the User information regarding the Service.  
 ② Should the User commit any of the following listed actions, Anyang can interrupt the use of all or part of the Service by the User within a designated time period or can cancel this User Agreement without giving prior notice:  
 
 A. when somebody else's User ID or Password were abused to use the Service  
 B. when a deliberate attempt to disrupt the operation of the Service was made 
 C. when a false name was used to register 
 D. when the same User registered using the same User ID or the same e-mail address in duplicate 
 E. when the User deliberately disseminates contents that go against the public peace or established social customs  
 F. when the User uses the service for the purpose of obstructing the nation from receiving a benefit or society from receiving a benefit, whether such a purpose actually takes place or was only being planned  
 G. when the User engages in actions that cause another person to be disadvantaged or to have their honor stained  
 H. when the User transmits a large amount of information for the purpose of obstructing safe operation of the Service or transmits publicity or advertising material 
 I. when the User distributes a computer virus that causes information to be destroyed or that causes IT equipment to malfunction 
 J. when a User violates the intellectual property rights of Anyang, another User, or those of a third party 
 K. when a request for correction is received from the Information & Communications Ethics Committee or from an outside institution, and when the Electoral Commission deems that the User is associated with illegal voter activity  
 L. when the User has duplicated, circulated, or used information provided by Anyang during the use of the Service for commercial purposes without the prior permission of Anyang  
 M. when other parts of this Agreement have been violated or in other cases where the conditions of use of the Service as set out by Anyang or legal directives related to such have been violated

Clause 21: Modifications to this Usage Agreement

① Anyang can modify this Usage Agreement provided that such a modification is not in violation of laws and legal directives pertaining to the stipulations of this Usage Agreement, the Basic Law Concerning Digital Transactions, the Digital Signature Law, the Promotion of Information and Communication Network Usage, and the protection of personal information.  
 ② When Anyang modifies this Agreement, the date the modification was made as well as the reason for the modification will be clearly specified and will be put on public display on the main screen together with the Usage Agreement that is currently in effect. 
 ③ The User has the right to reject the modified Agreement. Should the User choose to reject the Agreement, Anyang will abolish the agreement made with the User.

Implementation Clause
This Agreement has been in effect since September 5, 2011.

Privacy agreement

Protection of Private Information

① When Anyang collects the personal information of Users, it only collects the minimal amount of necessary required. The following listed items are to be regarded as necessary items and other items are to be regarded as optional items:  
 A. the User ID
 B. a Password 
 C. Name
 D. e-mail address 
 ② Anyang must of necessity get the permission of the User before collecting personal information.
